Policy Agreement — Jaliyah Graphics
Thank you for choosing Jaliyah Graphics (KVK: 87483920, Veemarktstraat 81, 3031NP Rotterdam) for your design and branding needs. This document outlines the official terms, conditions, and policies governing all services provided by Jaliyah Graphics. By engaging our services, you agree to comply with the policies described below.
1. Scope of Work
1.1 Jaliyah Graphics will issue a written project proposal that includes the scope, deliverables, timeline, and pricing. This must be accepted by the client before work commences.
1.2 Any amendments to the agreed scope must be submitted in writing and may result in adjusted pricing and deadlines.
2. Agreement Terms
2.1 All projects require 100% payment upfront. No deposits or split payments are accepted unless otherwise stated in writing.
2.2 Jaliyah Graphics will maintain regular communication via email or agreed channels.
2.3 The client must submit all required materials (e.g., text, photos, brand elements) within six (6) business days of project start.
2.4 Feedback, approvals, and revisions must be submitted on time to avoid delays.
2.5 Final approval must be provided in writing. Approval of a design confirms that the client accepts the work as final.
3. Expectations
3.1 Clients are expected to communicate respectfully. Any form of disrespect, harassment, or foul language will result in immediate contract termination without refund.
3.2 Projects delayed due to client inaction (no response within 15 business days) will incur a ghosting fee of 20% of the total project cost (in EUR or USD, depending on your invoice).
3.3 If no contact is made within 30 business days, the project is automatically closed without refund.
3.4 Clients are expected to respond promptly to communication to maintain the timeline.
4. Payment Policy
4.1 All projects must be paid in full upfront before any work begins.
4.2 Payments are accepted in EUR (€) for EU-based clients and USD ($) for international clients outside the EU. The applicable currency will be clearly indicated on your invoice or checkout page.
4.3 All payments must be made through our secure website or invoicing system. By submitting payment, the client acknowledges and agrees to all policies.
4.4 Rush projects (draft delivery only) are subject to an additional fee: starting at €50 / $55, depending on project complexity.
4.5 VAT (BTW) is included where applicable, according to Dutch tax law.
5. Refund Policy
5.1 Jaliyah Graphics has a strict no-refund policy on all design and digital services.
5.2 Refunds are not granted due to change of mind, delays caused by the client, or dissatisfaction after approved drafts.
5.3 Refund requests are only considered within six (6) business days of payment, and only if no work has started.
5.4 If a project is paused, it can be held for a maximum of 30 calendar days. After this period, a reactivation fee may apply.
5.5 Projects canceled due to policy breaches or unresponsiveness will not be refunded.
5.6 For downloadable products (e.g., templates), all sales are final. No refunds, returns, or exchanges are accepted.
6. Revisions Policy
6.1 All projects include up to five (5) rounds of revisions unless otherwise stated.
6.2 Additional revisions are billed at €40 / $45 per round.
6.3 Unused revisions are non-refundable and cannot be credited. If revisions are requested after the finalization of a project, the standard fee of €40 / $45 applies.
6.4 Revisions must be submitted within the agreed timeline. Delays may result in extended deadlines or additional fees.
7. Turnaround Times
7.1 Standard design turnaround is 10–14 business days for initial drafts.
7.2 Custom projects (e.g., websites, eBooks, planners) have longer timelines, communicated per project.
7.3 Rush options are available for an additional fee and apply to draft delivery only (not revisions).
8. Communication Policy
8.1 Jaliyah Graphics responds to emails within 24–48 business hours (Mon–Fri, 09:00–17:00 CET).
8.2 No communication is handled during weekends or Dutch national holidays.
8.3 Zoom or video meetings may be recorded for internal reference and quality assurance. By agreeing to a call, clients consent to this.
9. Posting Projects on Social Media
Unless a signed Non-Disclosure Agreement (NDA) is in place before project start, Jaliyah Graphics reserves the right to share project work across its portfolio, social media, and marketing platforms.
If privacy is a concern, this must be discussed before work begins.
10. Cancellation Policy
10.1 Jaliyah Graphics may cancel a project if the client violates this agreement, fails to make payment, or displays unprofessional behavior. No refunds will be issued.
10.2 If the client requests cancellation, payment for work completed to date is still required and non-refundable. Any remaining balance will not be returned.
11. Liability Disclaimer
11.1 Jaliyah Graphics is not responsible for errors in client-provided content (e.g., typos, image quality, incorrect information).
11.2 The client must review and approve all proofs. Final approval releases Jaliyah Graphics from any liability.
11.3 We are not liable for third-party printing errors, shipping issues, or use of files after delivery.
11.4 All original design concepts, working files, and drafts remain the intellectual property of Jaliyah Graphics unless explicitly transferred in writing. Final deliverables may be used commercially by the client, but resale or redistribution without permission is strictly prohibited.
11.5 Some assets may be generated or enhanced using licensed design software and AI tools (e.g., Adobe Firefly, Photoshop Generative Fill). Jaliyah Graphics ensures compliance with all usage rights.
12. Dispute Resolution
12.1 By paying for a service, the client acknowledges and accepts all policies as legally binding.
12.2 All disputes must be submitted in writing and will be evaluated based on communication records, delivery of work, and agreements made.
12.3 Any unresolved matters will be governed by Dutch law under the jurisdiction of Rotterdam, the Netherlands, unless otherwise required by the consumer protection laws of the client’s country.
13. Acknowledgment and Acceptance
By booking a service or making a payment, the client confirms they have read, understood, and agreed to these terms. Ticking the agreement checkbox or proceeding to payment constitutes a binding agreement between the client and Jaliyah Graphics.
This agreement ensures transparency, professionalism, and a seamless client experience for both parties.
